Spam Policy

We do not allow our Affiliates to promote or market memberships to our websites and products by the legal transmission of "permission" e-mails unless such marketing program is previously approved by us. We will only approve e-mailing promotions that conform to our policies and all applicable legal requirements. We have a ZERO tolerance for SPAM. If you are caught promoting any of our site(s) by the use of SPAM, you will be automatically terminated from the Program, and any funds that would have otherwise been due you from us, will not be paid.

We define "Spam" as the direct, or indirect, transmission of unsolicited bulk or other e-mails, i.e., not derived from a verifiable opt-in program which is exclusively yours or sent by you in reliance on a prior business relationship between you and the recipient. Any e-mail marketing activity by you, or on your behalf, that we determine may be the result of an unsolicited bulk or other e-mail program, or which violates the restriction on the use of Spam to promote our site(s) or which does not comply with the CAN-SPAM Act will result in your immediate termination from the Program and your forfeiting of moneys otherwise due you.

CAN-SPAM Act

As you are undoubtedly aware, the "Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003" or the "CAN-SPAM Act of 2003" (the "Act") went into effect on January 1, 2004.

We are committed to complying with the terms of the Act regarding the delivery of e-mail communications. You agree that you will comply with any and all applicable laws and regulations relating to the Act, including, but not limited to, the following:

1. All e-mails promoting our site(s) or containing advertisements for any of IntegralNet Marketing's site(s) must:
   1. contain, in all caps, the words "SEXUALLY-EXPLICIT:"
   2. have the phrase "SEXUALLY-EXPLICIT" in all caps in the "Brown Paper Wrapper" portion of the message. This is the portion of the e-mail that the recipient views upon opening the e-mail;
   3. indicate in the "brown paper wrapper" portion that the e-mail is an advertisement or solicitation, and must set forth your e-mail address that the recipient can reply to, or an opt-out link, opting out of any future e-mail advertisements or promotions from the sender;
   4. not contain in the "brown paper wrapper" portion any promotional images or text that are visible, without scrolling down or taking other steps to view the message, such as accessing the image by clicking to a link. You may include "softcore" images or text in the message below the "brown paper wrapper" portion; however, you may not include images that contain "penetration" or explicit frontal nudity. Obviously, any other sexually-explicit material cannot be utilized in any email advertisements promoting our Program;
   5. contain, in all email advertisements, your valid postal address, and, if possible, your phone number, as well as the statement that: This message is sent on behalf of:
      IntegralNet Marketing 6789 Quail Hill Pkwy #319, Irvine CA 92603
   6. not contain or include a false or misleading subject line that attempts to disguise or conceal the content of the e-mail;
   7. not contain or include a falsified sender domain name or non-responsive IP address;
   8. include valid and responsive contact information of the sender (as noted in (e) above), list manager or list owner. This includes such person's or entity's physical address and, if possible, phone number;
   9. refrain from seeking or obtaining unauthorized access to computers for the purposes of sending out commercial e-mail;
   10. not contain sexually-oriented material, as defined in Section 2256 of Title 18, United States Code, in the message that is opened by the recipient without requiring further action on the recipient's part. In other words, the e-mail may not have sexually-oriented material which the recipient accesses by merely opening the e-mail.
2. You may not send e-mails promoting any of our site(s) for the purpose of harvesting e-mail addresses. Please note that this prohibited activity includes any e-mails sent by you or on your behalf with the purpose (even if not the sole purpose) of harvesting e-mail addresses in order to send future unsolicited emails.
3. Any third-party agents, brokers or others that you may use to deliver e-mails must agree to comply with the terms set forth in this Agreement, and must also agree to indemnify you and IntegralNet Marketing for any breach of the obligations set forth herein. You must further agree with such third-party that you have the right, in your discretion or upon notification from IntegralNet Marketing, to immediately terminate such third-party without notice. Please note that we have a similar right to terminate you immediately as an affiliate for violation of any of the terms set forth in this Agreement without prior notice.
4. All e-mails sent by you must be sent to recipients who have provided you with documented permission and authority to send e-mail solicitations to them. You must keep a record of such authority and permission; for example, opt-in confirmation, e-mail request or other verification, to demonstrate that the recipient has in fact authorized e-mail transmissions from you to the recipient.
5. As noted above, every e-mail you send must have an "opt-out" feature. Any and all requests from a recipient to opt-out of future mailings must be acted upon by you as soon as practicable but, in any event, within 48 hours. You must keep accurate records evidencing all opt-out requests and your response to such request; you must produce to us any and all records required by this paragraph or by this Agreement immediately upon our request.
6. All e-mail transmissions must set forth language in the body and both the "from" line, as well as the "re:" or "subject" line, that clearly announces that the e-mail is being sent by you for your benefit and/or for our benefit and must also contain a clear and conspicuous identification that the e-mail message is an advertisement or solicitation.
7. Your compliance with the CAN-SPAM Act is a condition of your continuing to be an affiliate of IntegralNet Marketing. Remember, by accepting these terms, you agree to indemnify, defend and hold IntegralNet Marketing, its affiliates and advertisers harmless from any cost, expense or liability arising out of any breach or alleged breach of your obligations under this Agreement.

In the event of any breach by you, or any third party acting on your behalf, of these terms. we shall have the right, in addition to all other rights provided herein (and we will exercise such right), to permanently withhold any and all payments that may otherwise be due you.
